Outline of HB25-1294: Elimination of Court-Ordered Fines and Fees for Juveniles
Section 1: Prohibition on Court-Ordered Costs for Juveniles (C.R.S. 16-11-101.6)
Courts cannot assess court-ordered costs against a juvenile or their parent, guardian, or legal custodian.
The state cannot enforce or collect court-ordered costs imposed on or after July 6, 2021, if they remain outstanding.
Definition of Juvenile: A person under 18 at the time of the offense and under 21 at sentencing.
Section 2: Elimination of Community Service Fees for Juveniles (C.R.S. 18-1.3-507)
Courts cannot impose community service program fees on juveniles or their parents/guardians.
The state cannot enforce or collect outstanding fees imposed on or after July 6, 2021.
Definition of Juvenile: A person under 18 at the time of the offense and under 21 at sentencing.
Section 3: Removal of Sex Offender Surcharge for Juveniles (C.R.S. 18-21-103)
Juveniles and their parents/guardians are not required to pay sex offender surcharges.

Section 4: Elimination of Restorative Justice Surcharges for Juveniles (C.R.S. 18-25-101)

Section 5: Waiver of Public Defender Processing Fees for Juveniles (C.R.S. 21-1-103)
Juveniles and their parents/guardians are not required to pay the $25 public defender processing fee.

Section 6: Prohibition of Court Costs and Surcharges for Juveniles (C.R.S. 24-4.1-119)

Section 9: Prohibition of Court-Imposed Fines and Costs for Juveniles (C.R.S. 18-1.3-701)
Courts cannot impose fines or costs on juveniles or their parents/guardians.

Summary
Under current law, courts may not assess or collect administrative
fees, costs, and surcharges in juvenile delinquency cases involving a juvenile under the jurisdiction of the juvenile court when a juvenile has been charged with or adjudicated of certain crimes. The bill prohibits the courts or the state from assessing or collecting any administrative fees, costs, and surcharges assessed against a juvenile who is under 18 years of age when the crime was committed and under 21 years of age when sentenced or the juvenile's parents, guardian, or legal custodian.
