The bill will limit the length of unit trains.  This will impact the single largest way freight is used across the country.  This bill would limit cars from 200 to 120.  This creates more trips on the rail lines.

This is an effort to minimize frivolous lawsuits by making a person taking a landuse decision to court would be liable for attorney's fees.

Last year when the grant program was not renewed, there were 87 applications, of which only 30 could be funded.

Will require the state to provide more accurate timing and reporting for Division of Housing and results of activities.  Trouble managing their programs now.  This bill will force them to be more disciplined in reporting to the public.  Division sometimes will only take applications at certain times of the year when they have staff available and employee demand.  Discontent within the industry to approve rental assistance, foreclosures, eviction homeless programs.  Will need more people if they are going to do it faster $200k fiscal note 2 FTE added. 

Will apply to Fort Collins, Loveland and Greeley- Not in opposition to TODs but protecting the HUTF for communities to spend those dollars how the local communities think its best.  HUTF should not be used to penalize local governments.

Funding is ultimately coming from the TABOR Refund. Tied it to tax credits - oversubscribed on tax credits through CHAFA.  These will be new credits.  Ann- do we feel confident CHAFA has the ability, and is there a ban in the market -JOE, yes, CHAFA will have the capacity?  Demand will be 3 way.  Same players that use the state and fed program.  TABOR Refund comes from all the tax revenue, so this would take $ out of the state treasury and reduce the tax base and the revenue the state collects.  David B - feels like a shell game and redistribution of wealth.  Eventually, you run out of tax credit capacity. Potential legal action regarding the constant assault on TABOR. Carol - if this is helping first responders and taking the TABOR issue off the table.  If this helps middle-level employees to get a home loan, this would help and be the backbone of our society.  Teachers can't afford to live where they work.  Ann - these tax credits will go to the biggest of the big who are building.  We need to support middle housing Carol seconds.

API COGA partner's concern with EJ and perception of supporting pollution.  This should be a tougher bill, but I'm worried about messaging.  O&G is already in the middle of Cum Impacts rulemaking.  This bill is directed to Suncor.  Tom - Oppose and make general rules for enforcement.  Ann- C3 is Opposing

Already strong idle standards this broadens restrictions.  Enforcement will be difficult.  Tom- enforcement requirements of local govt mandates will make it difficult to execute. MONITOR and talk about enforcement. Ann falls into the progressive bucket thinking we can build bubbles over communities vs statewide.  Ann Oppose. Larimer Commissioners have already required citizens to turn off your car. Tom motion to Oppose. If this passes as an employer you will have to enforce it.

The tax credit should be applicable for projects less than $100m in investment—discussion of insertion of "or" less than 3 Megawatts.  We need to accommodate smaller capacity scale-up projects.

John Kolanz - Protection of Resources issues therefore, this should fall under the DNR not CDPHE.  DNR already has the expertise while CDPHE has a backlog of permits and currently requesting 24 FTE to catchup on permitting to get them to a 75% completion.

The bill sends the message to companies that impact the oil & gas industry they are not welcome 

The economic impact will be substantial with the lack of severance taxes. 50% of the DNR grant and operational budgets are derived from oil and gas taxes. 

Royalty interest owners will have takings cases. 

Currently the agencies don't have the capacity to promulgate rules and enforce existing rules with lack of staff resources.  This bill will drastically increase that problem

Because of the civil litigation aspect of the bill, NCLA opposes it.  The penalty amounts are monumental, and enforcement actions will be devastating.  The due process is questionable, and potential for frivolous lawsuits by individuals against a company for noncompliance.
